WEBSITE TERMS OF USE AND GENERAL TERMS OF THE CERTIFICATION SERVICE

1. Purpose
This document sets out, on the one hand, the terms of access to and use of the irice-certification.com website (hereinafter "the Website") and, on the other hand, the general terms applicable to the certification and assessment service provided by IRICE SAS.
2. Publisher
IRICE SAS, simplified joint-stock company with a share capital of €20,000, Aix-en-Provence Trade and Companies Register No. 835 324 112, registered office at 10 rue du Lieutenant Parayre, Espace Wagner Building A2, 13290 Aix-en-Provence, France. 3. Acceptance and access to the Website
Use of the Website implies acceptance of these terms. The Website is freely accessible. IRICE may modify, suspend or discontinue it at any time for technical, maintenance or update purposes.
4. Status of the published content
The content of the Website is provided for information purposes. It constitutes neither a consultancy service, nor support, nor a guarantee that a certification will be obtained. In accordance with ISO/IEC 17065, IRICE provides no consultancy or support service to the organisations it certifies.
5. Applicable standards and rule of precedence
IRICE operates under licence the standards owned by NORMATYS, a separate company within the NORMAXIS group. Those standards and the system conditions governing them are published under the NORMATYS programme at normatys.org.
In the event of any discrepancy, the system conditions published on normatys.org prevail.
These terms replace neither the system conditions, nor the certification contract signed between IRICE and the client, nor the trademark usage rules applicable to the scheme concerned.
6. General terms of the certification service
6.1 Scope
The certification service consists of assessing an object (real estate operation, development, construction site) against an applicable standard, followed by a certification decision taken by an impartial body within IRICE. Assessment and decision are two separate functions.
6.2 Client undertakings
The client undertakes to provide accurate and complete information, to grant access to the premises and documents required for the assessment, to inform IRICE of any change affecting the certified object, and to use the trademark and the attestations only under the conditions set by the applicable usage rules.
6.3 Decision, suspension and withdrawal
The certification decision is taken by IRICE on the basis of the assessment report and may be subject to reservations. The certificate may be suspended or withdrawn in the event of persistent non-conformity, misuse of the trademark, or communication inconsistent with the actual status of the project.
6.4 Client communication
The client may communicate about a certification only after a favourable decision and strictly within its scope. The corresponding rights and duties are detailed on the Rights and duties page.
6.5 Impartiality
IRICE acts as a third party independent of the owner of the certification system and of the assessed professional. IRICE and NORMATYS, owner of the standards, both belong to the NORMAXIS group: this link is disclosed and is subject to the safeguards described on the Impartiality page.
6.6 Confidentiality
IRICE treats as confidential the information obtained during the certification process, subject to information made public by the applicable standard (public registers) and to disclosures required by the accreditation body or by law.
7. Complaints and appeals
Any complaint about a service, and any appeal against a certification decision, is handled under the formal procedure described on the Complaints and appeals page. That procedure sets out the filing arrangements, the processing times and the impartiality safeguards applicable to the investigation. It is accessible without condition and free of charge to the complainant.
8. Intellectual property
The editorial content of the Website is the property of IRICE unless otherwise stated. The standards and the system conditions are owned by NORMATYS; the group trademarks are held by NORMAXIS. Any unauthorised reproduction or exploitation is prohibited under Articles L.335-2 et seq. of the French Intellectual Property Code.
9. Liability
IRICE takes all reasonable measures to ensure the accuracy, currency and accessibility of the information. IRICE cannot be held liable for errors or omissions in the content, for interruptions of the Website, or for the use made by users of the information published.
10. Personal data and cookies
The processing of personal data carried out through the Website is described in the privacy policy, which sets out in particular the data controller, the legal bases, the retention periods and the arrangements for exercising rights.
11. Amendment of the terms
IRICE may amend these terms at any time. The applicable version is that published online at the date of consultation.
12. Applicable law and jurisdiction
These terms are governed by French law. Failing amicable resolution, and after the complaints and appeals procedure has been exhausted where applicable, the competent courts shall be those of the jurisdiction of IRICE's registered office.
